Beware the Grand Solmar timeshare scam

We and a friend stayed at the Playa Grande in Cabo in March & took advantage of the "free breakfast & 90 minute presentation" (first mistake!) to see the Grand Solmar Land's End property. We will admit that we were impressed by the facility and beauty of the setting/property. The 3 of us decided to go in together to purchase a 2 bedroom condo (2nd mistake). We signed the papers, but the next day suffered from "buyer's remorse". We wrote a letter of rescission & hand delivered the letter to the business office within 36 hours, but didn't get a signed receipt (3rd mistake). Now they are not only saying that we never cancelled our contract, they are also saying that they didn't receive the letter. We are pursuing with our credit card companies, a lawyer and PROFECO (Mexican consumer fraud). The word of warning is this- be VERY careful what you sign. You are not in the US, you do not have 3 days "rights of refusal". If end up in our situtation.....either send the letter registered/certified or get a signed receipt. This has been a horrible experience and ruined a beautiful location and experience. We will NEVER go back to Cabo because of this & are telling anyone we know the same. It's too bad that bad operators like this ruin a wonderful location.

Thank you for posting this. I am in this type of situation myself, as we speak, however I hand wrote a letter, took pictures of it and will certify it by mail tomorrow morning. Very shakey tactics they present and pulled the bait and switch with me while I was sick! Wish me luck!

Can you give me an update? I am here now and in the process of filing my recession. Sad that they go to these lengths to sell. If they were legitimate they would not have to play hardball during the sale and after. Sell with truthfulness and "fiduciary responsibility" like their own salesman stated and we wouldn't be complaining!!!

Your situation was a lot like my husband and I. We are owners at Playa Grande and were looking to change our week from 42 to 52. No change in unit size or location, we literally is moving the week and getting the unit next door and was quoted almost $10,000. We initially thought it was very high but then we decided to go for it because week 52 was a better time for out kids to come with us.

We signed the new contract. Then we ran into a gentleman in the elevator when we got back to PG. He literally had a t-shirt on that reads "49/50 Eagle's nest 2 for 1". So, I asked him "are you advertising to sell your unit?" He said yes because when he bought the unit, he was promised a lot of things and nine of them have realized. He addressed the issues with management and they can't give him an idea as to when those things will become available for him. He now wants to sell and they would not help him.

After talking to him, we had second thoughts about my contract. Also we thought the price that we paid was too high anyways. Next morning my husband went and talk to the sales staff. He was referred to Dulce Calleros. Prior to going, we read through the contract and also did some research online. We knew that we have 5 business days to cancel. He cited the law to Dulce but she didn't really care. She told him that there is nothing she can do for us and that we cannot get a refund of our deposit and fees.

He came back fuming. That night we wrote up a rescission letter and we emailed it to all of the available email we can find for PG and Solmar staff. We also copied ResortCom and PROFECO. We request to cancel and sited our rights. We also notified our credit card company. The next morning (day 2 now), my husband also hand deliver a letter to Dulce and request for her signature of receipt and she refused to sign stating that we already sent an email and she will respond.

This time my husband gave her an earful of the scam business that her company is running, she keeps saying that the Legal Team will respond. She basically said she was just doing what she was told. He came back to the room at 11AM. By 11:30, we received an email from Dulce saying that she spoke with Sales Manager and we will be refunded in full and our contract has been cancelled. We still went to the post office and send a copy of our letter via certified mail to ensure that it's official. These people can't be trusted. Even though the have the out clause on the back of their contract, they will not point that out to you or even tell you the process to request for a cancellation. This company has a really bad business model. They just want their money and there is no such thing as customer service.

I bought a timeshare at the Grand Solmar I love the property but they are very bad when it come to loans or other wise. I signed a contract with them for a set price on a loan now they are increasing the amount of my loan payments. Unheard of in the US spoke to them and they told me to bad for me the taxes went up in MX so I have to pay more when I told them that would be a breach of contract they told me you are not in the US the laws are different here. I made a big mistake buying but I have to live with it. Beware dont buy anything in MX go on ebay and pay 100 bucks for something they are selling for 25k

I would like to know what the out clause means ? I am a owner me and my husband went in August 13 and we up grade and and they gave us till jan to pay are new down payment 3000. I've realize that it just not worth it and by time I pay off the loan it will be 30000 !! And the getaways are a joke u can't even stay at anywhere we would want . Dulce so crazy I been it contact with her what a joke one lady take care of the whole effin resort . I don't want a refund I just want to stop paying and I will not pay the 3000. What happen if I just stop paying?
