Where were you flying from and what was the reason for the delay/cancellation - Thai Airways would only be liable for compensation for flights departing from an EU airport assuming the delay/cancellation was not due to extraordinary circumstances such as weather.

Edit: If the flight was cancelled how long before scheduled departure were you notified of the cancellation.

The flight was Tg0917 from LHR to BKK. Supposed to take off 9.35pm on 7th Feb 2008. Only informed at 9.35 that there was a mechanical problem & that part would need to be flown in from Thailand. Sent to hotel & given little info. On 8th Feb told flight would now take off early on 9th Feb. Flight renumbered Tg9017 finally took off at 9.30am on 9th Feb. A total delay of 36 hours. No re-routing was offered and not told about Eu compensation. Wrote to airline on return to UK (March 2008) but all they offered were 2x £50 vouchers which were refused. Only found out about EU compensation recently & have been writing to airline since May 2013. Just wondered if anyone had had any success with Thai Airways.

Others might have had success but to be honest that's of little benefit to you as each case is decided on it's own merits - in light of recent EU rulings it seems clear that compensation would be due but Thai's response, or lack of, is fairly common across airlines.

You'll need to decide whether to put it behind you (some 5 years later) or are you prepared to go to the Small Claims Court, if you decide on the latter can you prove you were on the flight with boarding passes etc.

Flightstats.com can provide verification that this flight was cancelled-all you have to provide is evidence that you were due to fly on it

Compensation for delayed flights was not part of EU261 law in 2008, so at the time Thai did not owe you any compensation. On that front there was nothing to inform you about. They did provide duty of care.

The court ruling requiring compensation for delayed flights was made in 2009 (and made retroactive), then appealed and upheld late last year (when it became enforceable in the UK for the first time). The fact that the ECJ ruling is retroactive means that you can, should you choose, pursue TG for compensation. You have until six years after the date of the delayed flight to file your claim in court (should it get that far), meaning some time in March2014.

The flight is shown as cancelled on Flightstats.com & the new flight was given a different flight number. We don't have Boarding Cards but have booking refs & copies of electronic tickets. Thank you for all your advice. I will keep on trying!

Just a quick update. I completed a Money Claim Online & Thai have paid the compensation plus court fees a couple of weeks after they were notified of my claim by the court. It's definately worth being persistent!
