Flight delay Virgin Cancun 5 march 2013

We returned from Cancun with Virgin on 5 March 2013. The flight was supposed to depart from Cancun at 20:05 but was delayed by over three hours nearly midnight in fact;close to four hours

We claimed compensation under the EU Denied Boarding Regulation 261/2004 for a delay of over 3 hours.

Virgin have written back and stated that the flight arrived on 6 March only 2 hours 36 minutes late at 13.41 (due 11.05).

This we feel is not possible. It may be feasible though unlikely to make up over one hour on a 10 hour flight but we caught the first available train direct to Reading which would have been the 16.03 . We remember it was getting dark. If the flight had landed at 13:41we would have caught the 15.03

And it would have been daylight.

Did anyone out there experience this? Can they confirm arrival time? Any way we can check?

Coming back from Cancun, America Etc there is normally a very strong tail wind, so could definitely make up time! I came back from New York once and we were going to make such a lot of time up we had to sit and wait for an hour otherwise Heathrow wouldn't have been able to accommodate us so early.

According to Flightstats VS94 took off at 23.14hrs and arrived home at 13.41hrs next day making it 156 mins late

The data at Flightstats.com backs up Virgin. So you've got no valid claim for compensation.

If the flight had landed at 13:41 we would have caught the 15.03


Don't forget the time for the aircraft to get to the gate and you to get through passport control and baggage reclaim. This can be lengthy sometimes. Virgin would not lie to you about an arrival time.

I fly to / from cancun every march . The return flight ( cancun to gatwick) is always much quicker due to very strong tailwinds .this year it was quicker still as I was flying on a 747 ( virgin) which apparently has very strong engines that cut down the journey times ( outward was quicker too).

I'm sure that virgin are accurate in what they have told you
