Time share headache

Attended a timeshare presentation at club sunset in cancan, Mexico and liked what we were offered and signed purchase agreement on dec 31, 2011. On reading documents more thoroughly found that was offered was not in agreement. Went back to resort to cancel but due to the holiday was closed so on jan 2, 2012 met with sales manager to submit letter cancelling agreement. He was to expedite paperwork so we would have all looked after by time we left Mexico. We went back in two days time only to find that we had signed a paper saying we would not cancel. (Did not have copy). So we signed another letter cancelling our cancellation letter. Arrived home and addendums arrived by e-mail. These addendums have not been returned by us.

We sent three cancellation e-mails on Jan 6,2012 plus one registered letter to their US office in Miami. Contract says that there is a five day period in which a contract can be cancelled and are in contact with their legal dept and our visa cardholder services to see of this can be cancelled. Looking for any advise. If what they promised and what we get were the same we would not have a problem but this is not the case. It seems they will tell you anything to get you to sign then what they say just goes out the window.

Notify your credit card company that under the terms of sale you cancelled the agreement and want them to charge-back the merchant - provide back-up documentation - copies of correspondence, etc. -

Thanks. Already notified cardholder company - faxing all documents to them in AM. Letting legal dept of timeshare company know what we're doing. They are waiting for my registered letter to get there to verify time stamp for cancelling.

I know it is one day late (depending if they count New Years Day as a holiday).

I don't think holidays and non business days count toward the five days grace so you should be safe. I doubt there is much they can do to you from Mexico - what is important is that you get back your deposit if at all possible and make no further payments. Good luck.

Essentially what they told you will not matter, only what is in writing in the purchase agreement/contract. If you had a period to rescind as noted in the agreement and you met those terms you should be OK. Some US states count the weekend, while others require "business days" only. Again, the agreement should specify. In the absence of stating "five business days" . . . five days would include weekends. Who knows about Mexican law, however.

At this late date, there may be little anyone over at TUG can do to help you out . . . not much more than what's been offered here already.
